Andrew Graham

As an Associate Judge in the Ontario Superior Court of Justice, Andrew established a reputation for being extremely well-prepared for any hearing he conducted and demonstrated a strong commitment to helping the parties achieve settlements at settlement conferences. His practice experience in personal injury and insurance law was particularly helpful in mediating settlements of cases of that nature and he also developed expertise in resolving many other types of litigation, particularly employment law matters. His ability to communicate with francophone and Spanish-speaking litigants in their own language often proved helpful in cultivating their trust in the process and ultimately achieving settlements of their cases.

1985: Called to the Bar in Ontario

1985 – 2006: Civil Litigation Lawyer at Benson Percival Brown with focus on personal injury and insurance law, representing both plaintiffs and defendants

  • Appeared in all courts in Ontario, including in bilingual matters in Superior Court and the Court of Appeal
  • Instructor in Advocacy and Civil Litigation sections of the Bar Admission Course
  • 2004 – 2006: Worked as mediator as part of law practice

2006 – 2023: Master (Associate Judge since 2021) in the Ontario Superior Court of Justice 

  • Conducted in excess of 1,500 settlement conferences in all areas of civil litigation, with personal injury and employment matters being the most common 
  • Presided over motions, settlement conferences and case conferences including bilingual matters involving francophone litigants; also spoke Spanish in hearings when necessary to communicate with Spanish-speaking litigants
  • Regular speaker and panelist at Continuing Legal Education programs presented by the Advocates Society, the Ontario Bar Association, and the Toronto Lawyers Association, and guest lecturer in Civil Procedure at Lincoln Alexander School of Law (Toronto Metropolitan University) 
  • Numerous decisions reported in Carswell’s Practice Cases, the Ontario Reports and other case law reports
